Terms of Service
Effective date: August 2, 2026
1. Acceptance
By accessing or using realdealexchange.tech or any Real Deal Exchange AI platform (together, the “Services”), you agree to these Terms of Service. If you do not agree, please do not use the Services.
2. What RDX is — and what it is not
Real Deal Exchange AI LLC (“RDX”) is a Florida limited liability company that buys residential property for its own account and operates a real estate data, technology and marketplace platform.
We buy as a principal, for ourselves. When we contact an owner, we are a prospective buyer negotiating on our own behalf. We are not your agent, we do not represent you, and we owe you none of the fiduciary duties a licensed agent owes a client. Our interests as a buyer are not the same as yours as a seller, and you should assume that.
To be explicit about what we are not:
- Not a real estate brokerage. RDX does not list properties for sale, does not market property on behalf of owners, does not represent buyers or sellers in transactions, and does not charge or accept a commission for any of those activities.
- Not a lender. RDX does not originate, broker, service or solicit loans, does not extend credit, and does not offer refinancing, debt consolidation, foreclosure rescue, or any other credit product. Nothing on the Services is an offer of credit or an application for credit.
- Not a law firm, tax advisor, or financial or investment advisor. Nothing on the Services is legal, tax, accounting, financial or investment advice.
- Not a foreclosure rescue or “equity purchase” service. We do not offer to stop a foreclosure, repair credit, or help anyone stay in a home they are selling, and we charge homeowners no fee of any kind.
3. Fair housing and non-discrimination
RDX complies with the federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and the Florida Fair Housing Act (Fla. Stat. ch. 760, Part II).
We do not make, print, publish, or cause to be published any statement or advertisement that indicates a preference, limitation or discrimination based on race, color, religion, sex (including gender identity and sexual orientation), disability, familial status, national origin, or any other class protected by federal, Florida or local law.
We do not use any of those characteristics — or any data field that stands in for them — as a factor in deciding which properties to research, which owners to contact, what to say to them, or what to offer. The criteria we use describe the property and its recorded financial status: estimated equity, foreclosure and tax lien filings, occupancy, and whether the owner’s mailing address is elsewhere.
The same rule applies to every message we send, including any drafted with the help of automated tools. All outreach is reviewed and approved by a person before it is sent.
If you believe you have been treated unfairly by us, please tell us at contact@realdealexchange.tech so we can investigate. You also have the right to file a complaint directly with the U.S. Department of Housing and Urban Development at hud.gov/fairhousing or with the Florida Commission on Human Relations. Contacting us first is not required and does not affect your right to do so.
4. Creative financing — read this before you sign anything
RDX buys properties using structures often called “Subject-To” and “seller financing.” These are legitimate and long-established, but they work differently from a conventional cash sale, and the differences matter to you. In plain terms:
- Subject-To means we take ownership of the property while your existing mortgage stays in place — and stays in your name. We agree to make the payments. If those payments are not made, it is still your credit and your liability on that loan.
- Most mortgages contain a “due-on-sale” clause, which can allow the lender to demand payment of the full balance when ownership transfers. Whether a lender exercises that right in a given case is up to the lender.
- Seller financing means you are paid over time instead of all at once, and you carry the risk that comes with being owed money.
None of these are loans, and RDX is not lending you anything. They are terms of a purchase. We are describing them here so the structure is clear before there is any agreement, not to advise you on whether one is right for you.
Have your own attorney review any agreement before you sign it. This is the single most important sentence on this page. An attorney of your choosing — not ours — should explain what you are giving up and what risk stays with you. If cost is the obstacle, Florida legal aid organizations and The Florida Bar’s lawyer referral service can help you find representation.
5. Offers, and what they are worth
Any figure we present — an estimate, a range, or a written offer — is an invitation to discuss, not a commitment. Any offer presented through the Services is non-binding until a written purchase and sale agreement is executed by all parties, and may be subject to inspection, title review and verification of the facts we relied on.
Deposits and transaction funds are handled through escrow or title company accounts in accordance with the applicable transaction documents. RDX does not hold consumer funds.
You are under no obligation to accept any offer, and declining costs you nothing.
6. Property data
Property information available through the Services is compiled from public records and licensed data providers and is provided “as is.” Data may contain errors, omissions, or delays. You should independently verify any information before making a decision based on it.
7. How we contact property owners
We identify property owners through county public records and may contact them by phone, email or mail about buying their property. Where that information comes from, and how to stop hearing from us, are explained in our Privacy Policy.
We do not send text messages to anyone who has not asked us to. Text messages go only to people who requested an offer on this website and checked the text message consent box themselves. See section 7A.
The short version: reply STOP to any message and it stops immediately, on every channel, permanently. You do not need to give a reason.
7A. Text message program
Program: Real Deal Exchange AI LLC property offer updates.
What it is. If you request a purchase offer for your property on this website and check the text message consent box, we may text you about that request: updates on your offer, details, and arranging a call. Nothing else. Checking the box is optional — you can leave it unchecked and still receive your offer, and consent to text messages is never a condition of any purchase or of any other service.
Message frequency varies, and we send no more than 3 messages per day, between 8:00 a.m. and 9:00 p.m. in your own time zone. Message and data rates may apply.
To stop, reply STOP to any message. You will receive one final confirmation and no further messages. For help, reply HELP or contact us at contact@realdealexchange.tech.
Carriers are not liable for delayed or undelivered messages.
How we handle your mobile number, including that we never share it with third parties for marketing, is described in our Privacy Policy.
8. Acceptable use
You agree not to:
- Scrape, harvest, or systematically extract data from the Services;
- Use the Services for any unlawful purpose;
- Use any information obtained through the Services to discriminate against any person on a protected basis, or to harass, defraud or intimidate anyone;
- Use contact information obtained through the Services to send messages that violate the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act, CAN-SPAM, or any other communications law; or
- Interfere with the operation, security, or integrity of the Services.
9. Get your own professional advice
Real estate transactions have legal, tax and financial consequences that depend on facts we do not know about you. Before acting on anything you see here, consult a licensed attorney, a tax professional, and — if the decision involves your finances more broadly — a financial advisor, each of your own choosing.
Nothing on the Services substitutes for that advice, and no communication from us creates a professional relationship.
10. Intellectual property
All content, trademarks, and technology associated with the Services are owned by RDX or its licensors. You may not copy, reproduce, or create derivative works without our written permission.
11. Disclaimers & limitation of liability
The Services are provided “as is” without warranties of any kind. To the maximum extent permitted by law, RDX shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
Nothing in these Terms limits any liability that cannot be limited under applicable law, or waives any right you have under consumer protection, fair housing or telephone consumer protection statutes.
12. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
13. Changes
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
